House Bill 194 and Senate Bill 124 Information

Dear NPAA member,  

As promised on Friday, today, we want to discuss our proposed legislation in greater detail.  

First, many questions were asked about what exactly is the Joint Committee? So, let’s break it down: 

The Joint Committee (JC) is a collaborative committee established by the Alabama Board of Nursing (ABN) and the Alabama Board of Medical Examiners (ABME). Its PRIMARY PURPOSE is to MAKE RECOMMENDATIONS to the ABN and ABME who oversee and regulate  Certified Registered Nurse Practitioners (CRNPs) and Certified Nurse Midwives (CNMs) collaborative practice in Alabama. 

These recommendations pertain to collaborative practice including rules, protocols, and formularies. 

Key Functions: 

Reviewing Collaborative Practice Agreements: The committee reviews and approves agreements between nurse practitioners/nurse midwives and supervising physicians. 

Setting Practice Guidelines: Makes recommendations for protocols, formularies, and standards for collaborative practice. 

Advisory Role: Provides recommendations to both the ABN and ABME on matters related to advanced practice nursing. 

Ensuring Compliance: Helps to ensure that CRNPs and CNMs practice within the legal framework set by Alabama law. 

The committee plays a crucial role in advanced practice nursing and maintaining high standards of patient care in Alabama.

Second, we were asked why does this matter to Alabama Nurse Practitioners? 

Currently there is not a clear nomination and appointment process for CRNPs and CNMs to sit on this committee. 

The current composition does not reflect the growing diversity among CRNP/CNM practice.  

Currently the committee and respective boards lack a conflict resolution process to avoid delays in collaborative practice approvals.  

This piece of legislation was written in 1995 when there were less than a few hundred practicing nurse practitioners in Alabama with limited specialties. Now there are over 9000 NPs in Alabama practicing in multiple diverse environments.

Given this growth the composition of the Joint Committee should grow as well. Only 2 of the 3 nursing members currently hold advanced practice degrees and practice in a collaborative practice. There is a need for better representation of advanced practice providers on this committee that is crucial to our practice.

Who is carrying our bills?  

Head of the Health House Committee Paul Lee agreed to be the sponsor in the House of Representatives as well as Tim Melson agreed to sponsor the companion bill in the Senate. 

 

Now, let’s break down the bills.... 

Alabama House Bill 194 and Senate Bill 124 was composed by NPAA with the intention to revise the membership aspect of the Joint Committee (JC) of the Alabama Board of Medical Examiners (BME) and the Alabama Board of Nursing (ABN) to ensure fair representation for nurse practitioners and nurse midwives in developing practice protocols, formularies, and practice models for Certified Registered Nurse Practitioners (CRNP) and Certified Nurse Midwives (CNM) in collaborative practice in Alabama.  

What are the KEY CHANGES proposed?  

· 2 CRNPs and 1 CNM in collaborative practice 

· CRNPs appointed by the Nurse Practitioner Alliance Alabama (NPAA) 

· CNM appointed by Alabama Chapter of Nurse Midwives 

· Formal Process for Vacancies and dispute resolution 

What is our recommendation and why? 

· To call or email your local representative or senator and have them vote “YES” to HB 194 and SB 124 

· This bill plays a critical role in addressing provider shortages by improving CRNP representation, resulting in better collaboration, for improved patient outcomes.
